Terms of Use & Conditions

1. About these Terms

These Terms and Conditions (“Terms”) govern use of Young-Athlete.com and the website pages, online materials, accounts, booking tools, and digital services that we operate and expressly make subject to these Terms (collectively, the “Website”). They also establish general terms for purchases of Young Athlete services through the Website, subject to the separate agreements described below.

“Young Athlete,” “YA,” “we,” “us,” and “our” mean the operator identified above. “You” means the adult using the Website, purchasing services, or enrolling a participant. “Participant” means the person receiving services. When you enroll a minor, references to your responsibilities include the parental responsibilities expressly stated in these Terms.

You accept these Terms when you affirmatively agree to them through a checkbox, electronic signature, or other clearly identified acceptance process of purchasing our services. We make these Terms available for review before acceptance. Merely visiting the Website does not sign a participation waiver, authorize recurring charges, or grant permission to use a participant’s likeness.

If you do not agree, do not create an account, submit an enrollment, or make a purchase subject to these Terms. Contact us if you need assistance accessing or understanding them.

2. Separate agreements and order of priority

Participation may require a separate enrollment or service agreement, participant health information, a parent or legal guardian’s consent, an emergency authorization, and a conspicuous assumption-of-risk and liability-release agreement. Website acceptance does not replace those documents.

Applicable nonwaivable law controls over every agreement. Subject to that law, a signed service or enrollment agreement controls conflicting service-specific matters, a separately signed participation waiver controls its expressly covered risk and release matters, and these Terms govern general Website use. The package description and package rules displayed before payment and affirmatively accepted at checkout are incorporated into the purchase agreement. Those rules govern package-specific matters, including included sessions, validity, booking, cancellations, transfers, and refunds, subject to applicable law. The version accepted at purchase applies to that purchase; later edits to a package description do not retroactively change it. A later agreement modifies an earlier one only to the extent it expressly does so or clearly addresses the same subject.

Our Privacy Policy separately explains our handling of personal information. These Terms do not substitute for privacy notices or for consent required by privacy law.

3. Adults, minors, and enrollment authority

Only persons age 18 or older with legal capacity may purchase services, enter enrollment agreements, or create purchasing accounts. A parent or legal guardian must complete enrollment for a participant under age 18 and provide the required permissions before participation.

By enrolling a minor, you represent that you are the minor’s parent or legal guardian, have authority to enroll the minor and give the requested permissions, and have disclosed any custody or court restrictions relevant to enrollment, communications, emergency decisions, and pickup. A coach, team representative, relative, or other adult may not provide parental consent solely because that person is arranging a group booking.

You are responsible for your own payment commitments and for providing accurate enrollment and emergency information. These Terms do not represent that a minor personally agrees to all contractual obligations or that a parent can waive every right belonging to a minor.

The Website’s purchasing and inquiry functions are intended for adults. Children under 13 must not independently create accounts or submit personal information through our forms. Parents should submit inquiries on their behalf. Any permitted youth access to a coaching platform requires our approval, compliance with that platform’s age requirements, and any notices and parental consent required by law. This restriction does not replace our obligations under children’s privacy laws.

4. Services and eligibility

YA may offer strength and conditioning, speed and movement training, coordination exercises, personal training, small-group programs, off-season programs, nutrition education, recovery education, assessments, and digital coaching resources. Available services, age ranges, prerequisites, locations, schedules, and prices are stated in the applicable offer or enrollment agreement.

An inquiry, interest form, waitlist submission, or consultation request does not guarantee admission, availability, a reserved place, or a particular coach. Enrollment is complete only after our confirmation and completion of required documents and payment arrangements.

We may group participants by age, readiness, ability, safety needs, or program goals. Assessments are coaching tools and are not medical diagnoses or guarantees of future performance. YA complements sport-specific training; it does not control a club’s selection, playing time, coaching decisions, scholarships, recruiting, or competitive results.

5. Health information and training readiness

Before participation, you must provide accurate information reasonably needed for safe training, including relevant injuries, exercise restrictions, allergies, and emergency contacts. Notify us promptly of changes. We may require appropriate medical clearance or a return-to-activity authorization when reasonably necessary.

Participants must follow coaching directions, use equipment only as instructed, and immediately report pain, dizziness, breathing difficulty, concussion symptoms, or other concerning symptoms. Participants must stop an activity when symptoms arise or a coach directs them to stop. Do not attend while contagious or when participation conflicts with medical restrictions.

We may modify, pause, or decline an activity for a legitimate safety reason and will consider reasonable accommodations required by law. Providing health information does not transfer medical decision-making responsibility to YA or eliminate our own legal duties.

6. Training risks and separate participation waiver

Physical training involves risks, including falls, collisions, equipment-related injuries, strains, sprains, fractures, overexertion, heat illness, aggravation of existing conditions, exposure to communicable illness, and, in rare circumstances, permanent injury or death. Risks can arise during supervised activity and when following exercises away from our facility.

Participants should train within their ability, use appropriate footwear and clothing, and follow safety instructions. Remote workouts require a suitable space, properly maintained equipment, and supervision appropriate to the participant’s age and ability. A video, app, or written program cannot provide continuous in-person supervision.

This section describes risks; it is not a release of personal-injury claims. Any assumption of risk, release of ordinary-negligence claims, or related participant waiver must be set out in a separate, clearly identified agreement and is effective only to the extent permitted by law. Nothing in these Terms releases gross negligence, reckless or intentional misconduct, abuse, fraud, or liability that cannot legally be waived.

7. Nutrition and recovery education; no medical services

Unless a separate written agreement expressly identifies a licensed healthcare professional acting within that professional’s lawful scope, YA provides fitness coaching and general nutrition and recovery education, not medical care, physical therapy, psychotherapy, or medical nutrition therapy.

We do not diagnose or treat disease, prescribe medication, or replace advice from a participant’s physician or registered dietitian. Nutrition guidance for youth should support age-appropriate fueling, growth, and development. Medical conditions, suspected eating disorders, significant weight concerns, food allergies, and specialized therapeutic diets require appropriate professional evaluation.

Do not disregard professional medical advice because of Website content or coaching materials. Consult a qualified healthcare professional about medical symptoms, injuries, supplement suitability, or dietary restrictions. For an emergency, call 911; Website forms, email, messaging, and coaching apps are not emergency services.

8. No guaranteed outcome

Results depend on factors including attendance, effort, sleep, recovery, nutrition, growth, baseline ability, medical factors, and training outside YA. We do not guarantee a specific change in strength, speed, body composition, injury risk, sport performance, roster position, scholarship, or other outcome. Testimonials and examples describe individual experiences and are not promises of identical or typical results unless expressly stated and substantiated.

9. Prices, payment, and order acceptance

Prices are in U.S. dollars unless expressly stated otherwise. Advertised prices will include mandatory charges as required by applicable law. Any lawful exclusions, optional additions, and applicable taxes will be disclosed before payment.

Before purchase, we will disclose the services included, quantity or term, total price, payment schedule, and material cancellation, expiration, or renewal conditions. You authorize only the charges you expressly approve. A stored payment method alone does not authorize an unrelated purchase or recurring plan.

We may use third-party payment processors. You must have authority to use the payment method and keep billing information current. If a payment fails, we may request an updated payment method and suspend future bookings after notice, subject to law and the enrollment agreement. No late, collection, or returned-payment fee applies unless lawfully disclosed and agreed to in advance.

We may correct a material pricing or availability error before accepting an order. If payment has been collected for an order we cannot honor, we will notify you and offer the disclosed service at the agreed price or cancel and refund the affected payment. We will not charge a higher price without consent.

Nothing restricts lawful payment disputes, chargebacks, refunds, or rights against a payment provider. Contacting us first may help resolve a billing issue but is not a condition of exercising those rights.

10. Packages, reservations, and attendance

A package provides only the sessions or services identified at purchase. It does not guarantee unlimited access, a particular appointment, or placement in a specific class. Reservations are subject to capacity and eligibility.

Each package description sets out the applicable package rules. By affirmatively accepting those rules at checkout and completing the purchase, you agree to the rules presented for that package. Any package expiration, transfer restriction, reservation rule, cancellation deadline, or missed-session charge must be clearly disclosed before purchase. We will not impose an undisclosed expiration date or retroactively shorten the use period for a purchased package. Gift certificates and stored-value products remain subject to applicable gift-certificate law.

The late-cancellation and no-show policy expressly accepted at booking or enrollment applies. If no policy was disclosed and accepted, these Terms alone do not authorize forfeiture of a session or a late-cancellation fee. Please notify us promptly if you cannot attend. We may allow exceptions for emergencies without creating a continuing obligation to do so.

11. Refunds and legally required cancellation rights

Refund eligibility, including any permitted nonrefundability, follows the package description and package rules you accepted at purchase and any applicable service agreement, subject to mandatory law. Canceling a booking or package does not, by itself, establish entitlement to a refund. Refunds will be issued when required by applicable law or the accepted package rules. No package rule, including an “all sales final” provision, overrides a legally required cancellation or refund right. We will not apply an undisclosed retroactive repricing penalty to used sessions when calculating a refund.

California health studio services: Where California’s Health Studio Services Contract Law applies, we will provide a separate compliant written contract, a copy for the buyer, the required cancellation notices, and the legally required cancellation and refund rights. These Website Terms are not a substitute for that contract. Those rights may include an initial cancellation period, longer cancellation periods based on the contract amount, and cancellation rights associated with disability, death, qualifying relocation, or specified service or facility changes. Required deadlines and refund calculations control over inconsistent policies.

You may cancel through the cancellation feature in your customer account or by emailing the cancellation address listed above. A cancellation request should identify whether you are canceling an individual booking, a package, or an automatic renewal. The applicable package rules explain the effect of each type of cancellation, subject to statutory rights. You may also use first-class mail or in-person delivery where required by applicable law. Any additional cancellation method required by law or provided with your purchase is also available. Include enough information to identify the purchase; we will not require unnecessary information or a particular phrase where law does not permit it. We will acknowledge requests and process legally owed refunds within the applicable deadline. Cancellation is not conditioned on receiving our acknowledgment where applicable law makes notice effective earlier.

12. Recurring plans and automatic renewal

A one-time purchase does not automatically renew. Recurring billing applies only when a specific recurring offer is clearly disclosed and you separately give express affirmative consent to its renewal and billing terms.

Before enrollment in a recurring plan, we will disclose the charge, billing frequency, initial term and any minimum commitment, renewal term, trial or promotional conditions, and cancellation method. We will provide a retainable acknowledgment and required reminders and notices. We will retain evidence of renewal consent as required by law.

You may cancel renewal through your customer account or by emailing the cancellation address listed above. The account cancellation feature must directly process cancellation, rather than merely direct you to call us. If you enroll online, we will provide a direct online cancellation method that does not obstruct or delay cancellation or require a telephone call. We will also make available cancellation through the enrollment or customary interaction method where required by law.

Unless mandatory law or your service agreement gives an earlier cancellation or refund right, canceling renewal stops future renewals and permits use through the current paid period. A separately disclosed, lawful fixed-term installment obligation is distinct from permission to renew; statutory cancellation rights remain unaffected. We will not use an undisclosed advance-notice requirement to impose an additional renewal charge.

Material changes and price changes require the notices and any further consent required by law. If our system cannot support the legally required disclosures, consent, notices, and cancellation process, we will not offer automatic renewal through that system.

13. YA cancellations, schedule changes, and interruptions

We may make reasonable changes to instructors, equipment, or schedules, subject to the services promised and applicable law. We will give reasonable notice when practicable. If we cancel a paid session and cannot provide a mutually acceptable replacement, you may receive a credit or request a refund for the affected session.

If a closure, public safety order, severe weather event, utility failure, or similar event outside reasonable control prevents delivery, we will notify affected purchasers and offer an appropriate rescheduling, credit, or refund arrangement. We will not retain payment for permanently undelivered services where a refund is required. This section does not eliminate statutory rights arising from closures or material reductions in services.

14. Conduct, supervision, and pickup

Participants and accompanying adults must treat others respectfully, follow reasonable facility rules, and avoid bullying, harassment, threats, discrimination, unsafe conduct, and unauthorized recording. Do not photograph or record other participants without appropriate permission. Report safety or safeguarding concerns promptly; nothing limits reporting to law enforcement or another public authority.

For minors, parents must follow the disclosed check-in and pickup procedures and identify authorized pickup persons. YA supervises participants during the agreed session and any expressly accepted supervision period, subject to its legal duties. Enrollment does not include transportation, childcare outside that period, or permission for a minor to leave independently. Any independent-departure permission or transportation arrangement requires separate written authorization.

We may remove someone from an activity immediately for a reasonable safety concern and may suspend or end services for serious or repeated misconduct. We will apply these decisions consistently with nondiscrimination law and reasonable-accommodation duties. Any refund for unused prepaid services will follow law and the applicable agreement; termination does not automatically forfeit all unused payments.

YA is not responsible for personal belongings except to the extent loss or damage results from conduct for which YA is legally responsible.

15. Accounts, apps, and third-party services

Keep account credentials confidential, provide accurate information, and notify us promptly of suspected unauthorized access. You are responsible for activity you authorize, but these Terms do not make you automatically liable for every unauthorized transaction.

Booking, video, payment, and coaching services may be provided through third parties, whose separate terms and privacy policies apply to their services. We do not control unrelated third-party content or guarantee uninterrupted third-party availability. We remain responsible for our own legal obligations and our own selection, configuration, and use of service providers where applicable.

Links do not imply endorsement unless expressly stated. Material affiliate or sponsorship relationships will be disclosed where required.

16. Website use and intellectual property

We or our licensors own the Website’s protected text, training materials, graphics, videos, branding, and other content. Subject to these Terms, we grant you a limited, nonexclusive, nontransferable permission to access the Website and use lawfully obtained materials for personal, noncommercial purposes associated with the purchased service.

Do not resell or publicly distribute our paid programs, remove ownership notices, impersonate another person, introduce malicious code, access another person’s information without permission, bypass security controls, or use automated extraction that materially disrupts the Website or infringes legal rights. Lawful fair use, accessibility tools, authorized search indexing, and legally protected research are not prohibited by this section.

No trademark ownership or other intellectual-property ownership transfers to you. We may suspend Website access reasonably necessary to address a material breach or security threat, subject to rights concerning paid services.

17. Submissions, reviews, and photographs

You retain ownership of content you submit. You grant us a limited permission to use and process it only as reasonably necessary to respond to the submission, deliver services, and operate the relevant feature, consistent with the Privacy Policy. Do not submit content you lack authority to share or expose another person’s private information.

Submitting a testimonial, photograph, video, progress image, or feedback does not by itself grant permission for advertising use. Promotional use of an identifiable participant’s image, name, voice, or testimonial requires an appropriate separate authorization, including parent or guardian authorization for a minor and any other legally required consent. Participation is not conditioned on optional promotional consent.

Nothing in these Terms prohibits honest reviews, complaints, legally protected criticism, reports to authorities, or discussion of unlawful conduct. We do not claim ownership of reviews or require favorable feedback.

18. Communications and privacy

19. Community-support statements

If we advertise that a portion of a purchase supports athletes, teams, clubs, or another cause, the applicable offer will identify the contribution basis, any campaign dates or limits, and recipient information as required by law. Any use of “net proceeds” will be accompanied by a clear explanation of the calculation for that promotion. Such statements do not make a purchase a charitable donation or promise tax deductibility. These Terms do not narrow a specific contribution promise already made to a purchaser.

20. Website disclaimers

To the extent permitted by law, general Website content is provided “as is” and “as available,” without warranties of uninterrupted access, error-free operation, or suitability for a particular personal objective. We use reasonable efforts to maintain useful information but do not promise that every general article is complete or current. Contact us to confirm service-specific details.

These disclaimers concern general Website use. They do not disclaim an expressly promised paid service, required standards of care, nonwaivable warranties, or consumer rights. They do not excuse misleading advertising or materially inaccurate purchase disclosures.

21. Limited Website liability

To the extent permitted by law, YA and its owners, personnel, and agents will not be liable for indirect, incidental, special, or consequential damages arising solely from Website access, Website downtime, or reliance on general informational content.

For claims arising solely from those Website matters, aggregate liability is limited to the greater of $100 or the amount you paid specifically for Website access during the preceding 12 months, but only where such a limit is lawful and enforceable.

These exclusions and the cap do not apply to personal injury or death; in-person or remote training services; gross negligence; reckless or intentional misconduct; abuse; fraud or fraudulent misrepresentation; violations of law for which liability cannot be limited; legally protected privacy or data-security claims; required refunds; statutory damages or remedies that cannot be excluded; or other nonwaivable rights. Any separate participant release is governed by its own language and applicable law.

22. Responsibility for unlawful misuse

To the extent permitted by law, an adult user is responsible for losses finally determined by a court, or agreed in a settlement approved by that user, to have been directly caused by that user’s intentional unlawful misuse of the Website or knowing infringement of a third party’s intellectual-property rights through submitted content.

This section creates no automatic duty to defend us, does not impose personal liability on a minor, and does not require a parent to indemnify YA for a child’s injury claim. It does not cover YA’s negligence, misconduct, legal violations, or losses for which the user is not legally responsible.

23. Governing law and disputes

California law governs these Terms, subject to applicable federal law and mandatory consumer protections of your place of residence that cannot lawfully be displaced.

You may contact us to seek an informal resolution, but doing so is voluntary and does not delay a legal filing deadline. Unless mandatory law requires or permits another forum, disputes may be brought in the California state courts located in Placer County or the federal court serving that county, provided the court has jurisdiction. This provision does not restrict a consumer’s legally available small-claims forum or otherwise mandatory venue rights.

These Terms do not impose mandatory arbitration, waive a jury trial, prohibit class proceedings, waive public injunctive relief, shorten statutory limitation periods, or prevent a complaint to a government agency. Each party bears its own legal fees except where a statute or another enforceable agreement provides otherwise.

24. Changes to these Terms

We may update these Terms prospectively and will identify the effective date. For material changes affecting an existing contractual relationship, we will provide reasonable advance notice and obtain renewed acceptance where required. Posting revised Terms alone does not retroactively change an accepted purchase, impose a new waiver, or modify an existing dispute without legally sufficient agreement. Purchases remain governed by the terms accepted for that purchase unless a valid later modification applies.

25. General provisions and contact

If a provision is unenforceable, it will be severed to the extent legally permissible without expanding a waiver or defeating a required consumer protection. The remaining provisions continue in effect. Failure to enforce a provision once is not a continuing waiver.

Neither party may assign an agreement in a way that unlawfully reduces the other party’s rights. Subject to law, we may transfer these Terms with a bona fide business reorganization or sale if the successor assumes the applicable obligations and required notices are given.

Electronic records and signatures may be used where law permits, with required disclosures and consent. You may download or request a copy of accepted Terms and enrollment records. Nothing here substitutes for a separate electronic-delivery consent where one is legally required.

These Terms, accepted purchase disclosures, and applicable separate agreements form the agreement concerning their respective subjects. Nothing excludes liability for a misrepresentation or prevents reliance on legally binding service promises. Provisions intended by their nature to continue after termination survive only to the extent lawful.

Questions, cancellations, and legal notices may be directed to the operator’s email or mailing address available at the Contact Us page.
